DAMAGE & FEE SCHEDULE

This Damage & Fee Schedule is incorporated into and forms part of the Social Cues Terms of Use & Booking Agreement (the “Agreement”).
1. PURPOSE
Certain violations of the Agreement may result in damages that are difficult or impossible to determine with precision at the time of contracting. Accordingly, the amounts set forth in this Schedule represent reasonable estimates of anticipated damages, administrative costs, operational disruption, staffing expenses, increased risk, loss of use, and other related business impacts resulting from the identified violations.
Where applicable, Social Cues may recover either:
• the applicable fee or liquidated damages amount set forth in this Schedule; or
• actual documented damages,
but shall not recover both for the same underlying harm.
Nothing in this Schedule limits Social Cues’ right to recover actual damages where permitted by law.
2. OCCUPANCY, ACCESS, AND SECURITY

Tampering with locks, alarms, cameras, access systems, or security equipment | $500 |
Blocking emergency exits, fire lanes, or emergency access routes | $500 |
3. PROPERTY DAMAGE AND VENUE MISUSE

Minor property damage or misuse | $250 – $1,000 |
Damage resulting from unauthorized decorations or temporary installations | $250 – $1,000 |
Unauthorized movement of furniture requiring restoration or reset | $250 |
Damage to pool tables, audiovisual equipment, gaming equipment, or other specialty amenities | $500 – $1,000 per item |
Removal, disabling, or interference with Venue equipment | $500 |
Damage resulting from prohibited activities | $500 – $1,000 |
Where actual repair, replacement, restoration, labor, cleanup, or remediation costs exceed the amounts above, Social Cues may recover its actual documented damages to the extent permitted by law.
4. CLEANING AND RESTORATION

5. NOISE, CONDUCT, AND BUILDING IMPACT

Unauthorized DJ setup, live performance setup, or prohibited entertainment equipment | $500 |
Excessive noise requiring intervention | $250 |
Building complaints caused by Client or Guest conduct | $250 |
Material interference with neighboring occupants or businesses | $250 |
6. PROHIBITED ACTIVITIES

Smoking, vaping, hookah use, or activation of smoke-producing devices inside the Venue | $500 plus remediation costs |
Open flames, candles, sparklers | $500 |
Fireworks, pyrotechnics, or hazardous materials | $1,000 |
Ticketed event, admission fee, cover charge, public event activity, or unauthorized commercial, promotional, fundraising, marketing, retail, or revenue-generating activity | $1,500 |
Illegal activity requiring intervention | $1,000 minimum |
Law enforcement response resulting from Client or Guest conduct | $1,000 minimum |
7. OVERTIME
Unauthorized occupancy beyond the Rental Period shall be billed at:
TWO (2) TIMES THE APPLICABLE HOURLY RATE FOR EACH HOUR OR PORTION THEREOF.
The parties acknowledge that unauthorized occupancy may disrupt subsequent Bookings, staffing schedules, cleaning operations, building access, and Venue availability, making damages difficult to determine precisely.
8. CHARGEBACKS AND PAYMENT DISPUTES
If a chargeback, payment reversal, or payment dispute initiated by Client is ultimately resolved substantially in favor of Social Cues, Client shall reimburse Social Cues for:
• payment processor fees;
• bank fees;
• arbitration fees;
• chargeback administration fees;
• collection costs; and
• reasonable attorneys’ fees and costs, where recoverable under applicable law.
This Section does not apply to disputes resolved substantially in favor of Client.
Nothing in this Section limits Social Cues’ right to pursue any other remedy available under the Agreement or applicable law.
9. DOCUMENTATION AND ENFORCEMENT
Social Cues may rely upon surveillance footage, photographs, videos, access records, communications, witness statements, repair estimates, invoices, incident reports, staff observations, and other reasonably reliable evidence when assessing damages, fees, or violations under the Agreement.
Supporting documentation will be provided upon reasonable request where appropriate.
In addition to the amounts set forth in this Schedule, Client shall remain responsible for any documented repair costs, replacement costs, remediation costs, labor costs, governmental fines, landlord-imposed charges, insurance deductibles, lost revenue resulting from unusable Booking periods, or other actual damages arising from the Booking or the conduct of Client or Guests, to the extent permitted by law.
10. DE MINIMIS VIOLATIONS
Social Cues will not assess fees, liquidated damages, or other charges for purely technical, immaterial, or de minimis violations that result in no meaningful operational impact, safety concern, property damage, regulatory exposure, business disruption, or financial harm.
Nothing in this Section limits Social Cues’ right to:
• enforce the Agreement;
• issue warnings;
• require corrective action;
• remove Guests where appropriate; or
• address repeated or continuing violations.
The parties acknowledge that this Schedule is intended to compensate Social Cues for meaningful violations causing actual or anticipated harm and is not intended to impose penalties for insignificant technical non-compliance.
