VENUE PRIVACY & SURVEILLANCE NOTICE

This Venue Privacy & Surveillance Notice is
incorporated into and forms part of the Social Cues Terms of Use & Booking
Agreement (the “Agreement”).
1. VENUE MONITORING
Client acknowledges and agrees that the Venue may be
monitored by video surveillance and other reasonable security measures for
legitimate business purposes, including:
•
safety and
security;
•
loss prevention;
•
occupancy
monitoring;
•
property
protection;
•
incident
investigation;
•
dispute
resolution;
•
assessment of
damages and fees;
•
insurance matters;
•
enforcement of the
Agreement and incorporated policies; and
•
compliance with
legal, insurance, landlord, and building requirements.
By entering or using the Venue, Client and Guests
consent to such monitoring to the fullest extent permitted by applicable law.
2. AREAS EXCLUDED FROM MONITORING
Social Cues does not intentionally monitor or record
individuals in:
•
restrooms;
•
changing areas; or
•
any location where
individuals have a reasonable expectation of privacy under applicable law.
Nothing in this Policy authorizes monitoring in any
area where such monitoring is prohibited by law.
3. USE OF RECORDINGS
Surveillance footage, recordings, photographs, access
records, and related information may be used by Social Cues for legitimate
business purposes, including:
•
security
investigations;
•
incident
investigations;
•
occupancy
verification;
•
enforcement of the
Agreement and incorporated policies;
•
assessment of
damages, fees, and other charges;
•
payment disputes
and chargebacks;
•
insurance claims;
•
legal proceedings;
•
arbitration
proceedings; and
•
protection of
persons, property, and business operations.
Client acknowledges that such information may be used
as evidence in connection with disputes arising from a Booking.
4. PHOTOGRAPHY AND RECORDING BY GUESTS
Guests may take photographs and videos during private gatherings.
Client is solely responsible for obtaining any
permissions, consents, releases, licenses, or other authorizations required
from individuals appearing in photographs, videos, recordings, livestreams, or
other content created by Client or Guests.
Social Cues assumes no responsibility for content
created, recorded, streamed, published, or distributed by Client or Guests.
5. PUBLIC CONTENT
Client acknowledges that Client or Guests may
voluntarily post photographs, videos, reviews, social media content, tags,
check-ins, geotags, or other publicly available content relating to the Venue.
Social Cues does not control content created or
published by Clients or Guests and assumes no responsibility for such content.
Social Cues may repost, share, reference, display,
publish, or otherwise use publicly available content that identifies, tags,
geotags, references, or depicts the Venue for marketing, advertising,
promotional, or other legitimate business purposes.
Nothing in this Policy transfers ownership of
Client-created content to Social Cues.
6. INFORMATION SHARING
Social Cues may disclose information, surveillance
footage, recordings, access records, Booking records, communications, incident
reports, or related information:
•
to insurers;
•
to legal counsel;
•
to payment
processors;
•
to identity
verification providers;
•
to building
ownership or management;
•
to governmental,
regulatory, or law enforcement authorities;
•
pursuant to
subpoena, court order, or other lawful legal process; or
•
where reasonably
necessary to protect persons, property, legal rights, or business operations.
Social Cues will not disclose information except as
reasonably necessary for these purposes or as otherwise permitted or required
by law.
7. DATA RETENTION
Social Cues may retain surveillance footage, Booking
records, communications, incident reports, access records, and related
information for such periods as Social Cues reasonably determines necessary for
operational, legal, insurance, evidentiary, security, compliance, archival, or
business purposes.
Retention periods may vary depending upon the nature of
the information and the circumstances giving rise to its creation.
8. NO EXPECTATION OF PRIVACY
Except where prohibited by law, Client and Guests
should not expect privacy in gathering spaces, entrances, exits, hallways,
common areas, or other portions of the Venue that are subject to monitoring,
occupancy verification, or security measures.
This Section does not diminish any privacy rights that
cannot legally be waived.
9. CLIENT RESPONSIBILITY
Client is responsible for informing Guests that
surveillance, monitoring, photography, recording, and social-media-related
activities may occur during the Booking.
Client assumes responsibility for claims arising from
photographs, videos, livestreams, recordings, or other content created or
published by Client or Guests.
10. SURVIVAL
The rights and obligations contained in this Venue
Privacy & Surveillance Notice shall survive the completion, cancellation,
expiration, or termination of a Booking to the extent reasonably necessary to:
•
preserve evidence;
•
investigate
incidents;
•
resolve disputes;
•
collect unpaid
amounts;
•
satisfy legal or
insurance obligations;
•
enforce the
Agreement or incorporated policies; or
•
protect the
rights, property, or legitimate business interests of Social Cues.
